The Trouble with Birther Bills

I noted yesterday morning that “birther bills” had been introduced in more states since the start of their new legislatures. A friend pointed out that some of the bills go further than demanding proof of birth in the United States. Here’s one clause from Arizona’s bill:

A sworn statement attesting that the candidate has not held dual or multiple citizenship and that the candidate’s allegiance is solely to the United States of America.

And from Nebraska’s:

Each person who wishes to have his or her name placed on the general election ballot as a candidate for President or Vice President of the United States shall first meet the eligibility requirements of Article II, section 1, of the Constitution of the United States. Such person shall submit an affidavit to the Secretary of State along with supporting documentation as specified in subsections (5) and (6) of this section by September 8 of the year in which the election is scheduled. The affidavit and supporting documentation shall be a public record.

(5) The affidavit shall be sworn or affirmed before a notary public and shall contain statements substantially as follows: I was born a citizen of the United States of America and was subject exclusively to the jurisdiction of the United States of America, owing allegiance to no other country at the time of my birth. On the day I was born, both my birth mother and birth father were citizens of the United States of America.

My emphasis. Both of these items apply specifically to Barack Obama. And both are unconstitutional. Article II, Section I only requires that a president be 35 or older and “a natural born Citizen, or a Citizen of the United States.” Birthers argue that because Obama’s father was a Kenyan citizen, he had dual citizenship at birth, and they believe that both of a candidate’s parents need to be U.S. citizens. This just isn’t how the Supreme Court has interpreted the issue. In U.S. v. Wong Kim Ark (1898), the Supreme Court ruled that a child born in America to two Chinese citizens was, himself, Americans.
So birther strategy is evolved, and it might force a lawsuit if a bill like this passes, but it’s the same legal garbage as ever.

A celebrity journalist made a shocking claim recently that the governor of Hawaii said there is no Obama birth certificate - but now says he was misunderstood.
Radio personality Mike Evans told KQRS-FM in Minnesota on Jan. 20 that Gov. Neil Abercrombie, recently sworn in as the "The Islands of Aloha"'s top executive, admitted that no record existed of President Obama having been born in that state.
Claiming that he and Abercrombie had been friends for "decades," Evans stated, "Neil promised me that when he became governor he was going to cut through all the red tape. He was gonna get Obama's birth certificate, once and for all, and end this stupid controversy."
Abercrombie has since backed off his boast that he would prove Obama's birth this week, since Hawaii law prevents personal information such as birth records to be released.
Evans went on to tell KQRS that he talked "with Neil's office, Neil says that he's searched everywhere using his power as governor" at the two hospitals Obama was likely born at in 1961 - Kapiolani Medical Center and Queens Medical Center - only to come up empty.
"There is no Barack Obama birth certificate in Hawaii," Evans claimed he was told by the governor's office. "Absolutely no proof that he was born in Hawaii... now [Abercrombie] admits, publically, that there is no birth certificate."
Evans now says it was all a big misunderstanding.
"This I can you tell you is 100% fact," he told Fox News. "Neil never told me there was no birth certificate... I never talked to him."
Evans told the Daily News in an e-mail that he was "STUNNED!" when his statements appeared in headlines nationwide.
"I NEVER knew I said it until I heard it," he wrote, adding that he feels "embarrassed" by the entire incident. "NO MORE POLITICS FOR ME!!" the entertainment journalist said. "For now on, I'm sticking with Lindsay Lohan and Snookie stuff."
Evans told the News it was an online article with a misleading headline that had caused him to even call Abercrombie's office.
The article cited an interview the governor had done with the Honolulu Star-Advertiser, during which he mentioned Obama's birth certificate.
However, while the article "suggests" the governor said he could not find the birth certificate, he never makes any such statement in the Star-Advertiser interview. In fact, he indicates that a record of Obama's birth does exist.
"It actually exists in the archives, written down," he said, although it is unclear what kind of record he is referring to.
Evans indicated that one portion of the article's final paragraph sparked him to call Abercrombie's office. It states:
"Tim Adams, a former senior elections clerk for the city and county of Honolulu in 2008, has maintained that there is no long-form, hospital-generated birth certificate on file with the Hawaii Department of Health and that neither Honolulu hospital – Queens Medical Center or Kapiolani Medical Center – has any record that Obama was born there."
Adams has stated in the past only that he was "told at the time" that there was no birth certificate. However, even he believes Obama is a citizen.
"Since Obama does have a certificate of live birth from the state of Hawaii... he was born a U.S. citizen," he said in a TV interview.
Evans' comments kicked off a series of reports that have fueled the fringe "birther" movement, which has claimed since 2008 that President Obama is not eligible to be commander-in-chief. Their conspiracy theories suggest he is not a "natural born citizen" because his father was a British subject, and also claim Obama was really born in Kenya or Indonesia.
Obama made his certification of live birth public in 2008, and even Congress stated in 2009 that he was born in Hawaii.
Legislation dubbed the "Birther Bill" was re-introduced in Arizona earlier this week directed specifically at Obama, which would require anyone looking to get on presidential ballot in the state to produce a long-form birth certificate.

"The Radio Patriot" is a flat-out liar

There's a program on Blog Talk Radio called, "The Andrea Shea King Show." Its host, who goes by the nickname of "Radio Patriot," has on her web page a kicky little picture showing her playing "dress-up like a real-life journalist:" she's wearing a hat with a "Radiopatriot PRESS" card stuck in the hat band. Very old school; we don't wear those kinds of things anymore. (Although it would be pretty cool. But I digress.)

Anyway, as you can imagine, "The Radio Patriot" is a Birther site. And on Jan. 21, 2011, Ms. King had on as guests Greg Lakin, the brother of (soon to be ex) Army LTC. Terry Lakin, and Marco Ciavolino, trustee of a fund raising effort for Terry Lakin. Terry Lakin is the (soon to be former) Army doctor who 's serving three months in a military prison after he was convicted of a charge of missing a movement, and plead guilty to a charge of failing to report to his superior officer. Lakin, also a Birther, claimed that he couldn't deploy to Afghanistan until he knew for sure that President Obama was Constitutionally qualified to serve as Commander in Chief. Of course, he did that after he took his taxpayer-funded leave prior to his deployment.

As it was learned during his court martial, another soldier had to deploy in his place, on short training, and wreaking havoc with his personal life. But stuff like that doesn't matter to Birthers, so long as they get what they want.

One of the "proofs" Lakin wanted was a copy of Obama's original long-form birth certificate from Hawaii, even though Hawaiian officials have said they are not issued anymore, and created the Certification of Live Birth in their place. Obama's non-compliance with their demand is their evidence that he does not have one from Hawaii, and was really born somewhere outside the U.S. (Of course, even if he did show it, that wouldn't satisfy Birthers, but that's another entry.)

Anyway, this King woman has a call-in segment to her program, and one of her callers was a fellow who identified himself as "Spackle," but who also goes by the handle Foggy. He's a denizen of a Birther-truth forum called The Fogbow (h/t to him for giving me the heads-up on this). In his call, Foggy noted that Terry Lakin's daughter was born in Hawaii -- which Lakin's brother confirmed -- and asked if the almost-former LTC had tried to get her long-form birth certificate.

Greg Lakin allowed to how his brother had tried to do so, but was unsuccessful. Greg Lakin even said he tried to get one in person, but the office was closed. (It was a Friday, and state offices in Hawaii were closed every Friday to save money.)

Here's a transcription of the conversation, as it happened, and here's a link to audio:

Foggy: Hello, can you hear me?

ASK: Yes, we hear you loud and clear.

Foggy: OK. Just checking. I'm "Spackle" in the chat room. And I have a question for Greg, which is, doesn't Terry have a daughter that was born in Hawaii?

Greg: He does. He was at Schofield Barracks for many years, at the military base there as a physician. His daughter was born in Hawaii ...

Foggy: So I'm wondering why ... it probably would have made his appeal to the public more powerful if he had gone ahead and gotten a long form birth certificate for his daughter. If he could order one today, y'know, like everybody wants Obama to do, and pay ten or fifteen bucks to order the long form birth certificate, and then show it to people and say, "I got my own daughter's long form birth certificate, how come Obama can't get his?" Did he ever try that?

Greg: You know, he did, and I actually ... he tried to do it through the mail, and I actually tried to do it personally when I was over there, because I've spent time in Hawaii too, and the Office of Vital Statistics was closed that Friday.

But I will tell you that he's ... as a physician over there, he's seen numerous birth certificates, and that Certificate [sic] of Live Birth is something he'd never seen before, nor is it a birth certificate.

And then he personally signed off on ... he's been the delivery physician, not in Hawaii but at Fort Bragg ...

Foggy: Wait a minute. Are you saying the Certification of Live Birth is not a birth certificate?

Greg: I'm saying it's not the original birth certificate, or a copy of the original birth certificate.

Foggy: No, it's not. It's not. I agree with that but I mean ... in any event, so he never actually did pursue it and try to get a copy of his own daughter's long form birth certificate.

Greg: You know, I honestly can't answer that. I know she has one. I know she has one, just like all birth certificates, you know, all birth certificates that I've signed have location and doctor's name and other people ... they have information on them. And so I know that his daughter has one. But yeah, no I don't know if he's personally got one or could do that, in any type of ... Would it be compelling evidence? I think you're probably right.

Foggy: I just posted a link in the chat room. And if you go to that link, the Hawaii government state website says you can't get a long form birth certificate any more1 ... even if ... and that's a link to a program they do for Native Hawaiians, y'know, ethnic Hawaiians, that if you're more than 50% ethnic Hawaiian, they try to help you with all kinds of programs, it's called the Hawaiian Homelands Program.

And they say they prefer the long form birth certificate if you have one, but they explain on the website that they don't give them out any more, and that if you don't have your long form birth certificate right now, if you apply for a birth certificate, you're gonna get a COLB, a Certification of Live Birth, just like the one that Obama published, and that's why I was wondering, the state of Hawaii ... that even for people they're trying to help because they're ethnic Hawaiian, if they can't get a long form birth certificate, and if Terry couldn't get a long form birth certificate for his own daughter, then how is President Obama supposed to get a long form birth certificate for himself?

Greg: Right.

ASK: Well, that's a good question. Yeah.

Greg: Well, I think that's something that's fairly recent within the last few years, because it's always been ... before ... y'know I understand we've all gone to electronic records now, but ...

Foggy: Right. In the state of Washington, the only birth certificate that you get is a little card that fits in your wallet.

Greg: Um hm.

Foggy: And I live in North Carolina, and in North Carolina all you can get is a short form birth certificate too. So I just don't understand how President Obama could get ... unless they put him above the law that says that you can't get a long form birth certificate any more. I don't see how he could possibly get a long form birth certificate.

Marco: Andrea, this is Marco, let me just address that, because we're getting in the last few minutes, there's a few more things to cover.

ASK: Yep. Yep.

Marco: This is one of the issues, and I appreciate your comments in fact I think it's a very clever idea, but what we're missing is that the birth certificate is just part of the equation. As Greg just indicated, it's not even the physical sheet of paper, though everyone's expected to have one in this country ...

Now something strange happened to that conversation from the time it occurred to the time Andrea Shea King posted a recording of it on her program's web site: it shrank by a few minutes!

And oddly enough, the part that's missing is the salient point of Foggy's comment. Here's a transcript of what you'll hear if you listen to the archived program (audio):

So, not only did she edit out Greg Lakin's admission that his brother couldn't even get a long-form birth certificate for his own daughter, she completely changed the context of the comment! She took what was really a question challenging Lakin's case, and made it into a statement supporting Lakin! (Don't believe me? Here's a link to the archived program. The relevant part starts at about minute 46. You can fast-forward by pushing the "right" arrow on your keyboard.)

As a side note, it's important to point out that Laking went ahead with this ridiculous cause even though he probably knew, from his own experience, that Obama could not get a long-form birth certificate. I've no doubt that Lakin is a smart man, you don't get to be a surgeon and an officer in the US Army (usually) otherwise. But I've said it many times before, some of the smartest people I know have zero common sense.

I've seen some willfully dishonest stuff in my life, but this ranks at the top of the list. Andrea Shea King, you ought to change the type on your phony press card to "Birther Propagandist." You ought to be ashamed of yourself, but I know you're not. How nice it must be to travel through life, free of the troublesome burden of a conscience.

MAybe if you geniuses would actually read you would discover that the governor never said that....The governor stated that there is proof that exists in the HI archives of the President's birth.  And quite possibly Beck can read and realizes that the teh governor did not say it did not exist, and unlike WND and the Obama hate sites doesn't want to print lies.  Or maybe he knows that the birther issue is a loser since every case has been dismissed and the only one that had been ajudicated in Indiana went against the birthers....

The National Enquirer is reporting that Sarah Palin's husband, Todd, is embroiled in a sex scandal involving an extramarital affair with a massage therapist who has been "busted for prostitution."
The Enquirer claims it has unearthed official documents showing 36-year-old Shailey Tripp was arrested for maintaining a house of prostitution in March and that cops have confiscated physical evidence that could tie Todd to the alleged affair.
The tabloid did not disclose when the alleged rendezvous took place or what evidence was seized by police.
The Palins, who have previously been dogged by cheating allegations in 2008 and 2009 and have vehemently denied each and every accusation, though they have not commented on the Enquirer story.
In the same Jan. 31 issue in which the National Enquirer reports the Palin scoop, it also reports that Jennifer Aniston has a drinking problem and President Obama is stick-thin because he has stomach parasites.
 Still, the tabloid broke the story of the biggest political scandal since Bill Clinton and Monica Lewinsky, when it reported ex-VP and presidential candidate John Edwards' affair with a campaign videographer.
The Palin story, writes the tabloid, began after several media outlets received an anonymous e-mail from thepalinmorals@hotmail.com claiming Tripp had an affair with Todd, which eventually led to Tripp's arrest in March 2010.
"According to the tenants in the building of her offices, they saw Todd come and go often and heard noises that sounded like someone was having sex," the e-mail read.
A woman by the name Shailey Tripp is listed as a massage therapist in Wasilla, Alaska. Calls to the listed phone number were not returned.
The Enquirer claims its investigation revealed that Tripp, 36, was arrested on March 4 in Anchorage and charged with having a house of prostitution.
Tripp pleaded no contest on June 13, 2010, according to the tabloid, and has a sentencing date set for June 15, 2011.

An Open Letter To Birthers: Find a New Way To Question Obama’s Eligibility

Dear Birthers:

It’s okay, I’m white.

Listen up, you guys: I like what you’re doing. I do. It’s very entertaining. Even your name is funny! Your undying Birther devotion to your initial impulse that the president of the United States “doesn’t seem like he’s from around these parts” is adorable. But I’m afraid this birth certificate thing is just becoming banal. It’s just not going to sustain itself for two more years. You need new ideas. And I’m here to help.
Let’s keep with this whole eligibility thing. It’s your brand. It’s what people know you for, and I don’t want to mess with that. When people come for you for ridiculous points of view, they expect you to stick to your guns. You won’t even let your brains’ comprehension of this presidency get past square one, and I respect that.

But let’s mix it up a little. You like the Constitution? Sure, you love it. You love it so much you chopped it up into pieces, put it in the blender, and snorted it. So let’s explore that a little more. Here are some suggestions:

Look at this line from Article II:

The Congress may determine the Time of chusing the Electors, and the Day on which they shall give their Votes; which Day shall be the same throughout the United States.

“Chusing”? What the hell is that? Congress may have done some “choosing,” but it certainly didn’t do any “chusing.” ELECTION INVALID, DO OVER.

You also love the next line, as we know:

No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President

You of course focus on the “born Citizen” part, but what about this “at the time of the Adoption of this Constitution” thing? Where is the evidence Obama was born before the Constitution was ratified? He hasn’t show anything, though the Constitution seems to say, in between all its commas, that the president must be at least 222 years old to hold the office right now. Which means John McCain is the only one in the country eligible for the job.

And then there’s the next line:

The President shall, at stated Times, receive for his Services, a Compensation, which shall neither be increased nor diminished during the Period for which he shall have been elected

You see how the founders capitalized “Services” and “Compensation” like that? It’s because they’re euphemisms for sex stuff. Obama is collecting a paycheck, yet he’s not whoring himself out for sex with any American who wants it — a clear violation of his duties. The job begins when he performs his first back-alley blowjob, obviously, so his presidency hasn’t even begun.
See, these reasons are just as good at denying Obama’s eligibility to be president as refusing to believe all the evidence Obama was born in Hawaii, but they put a little spice into your favorite activity. Please choose one and go with it for a little while. You’re getting really boring.

Officials in Hawaii have tracked down papers indicating that President Obama was indeed born in their state, according to its new governor.

Gov. Neil Abercrombie, who took office in December, told Honolulu's Star-Advertiser on Tuesday that "our investigation" indicates there is a recording of his birth.

"It actually exists in the archives, written down," he said.

The new Democratic head of the state vowed when he took office that he would do his best to end the debate over Obama's birth, which began in 2008 during the presidential campaign.

"We'll do what we can as quickly as we can to make it inevitable that only those who wish the President ill, only the ones with a political agenda, will be the ones doing this kind of thing," Abercrombie told CNN in December. "The President is entitled to the respect of his office and he's entitled to have his mother and father respected."

During that interview, Abercrombie said his goal to combat birthers was a personal one.

"It's a matter of principle with me," the 72-year-old said. "I knew his mom and dad. I was here when he was born. Anybody who wants to ask a question honestly could have had their answer already."

On Tuesday, he again promised he would do "what I can do" to publicly verify that records show Obama was born in Hawaii and is a citizen of the United States, making him eligible to be President.

Birthers insist that the President, born in 1961, is not eligible to be commander in chief. The reasons often vary, and have changed and expanded in the two years since the Internet rumor began.

Some believe his Certification of Live Birth is fake and he was really born in Kenya. Others argue that Obama is a citizen of the United Kingdom or Indonesia. Most theories have been dismissed by many in public office and the media, and have been found to be misleading or generally untrue.

However, the conspiracy theories still thrive, and according to Abercrombie, likely will continue despite whatever evidence that shows him to be a proper U.S. citizen.

"You're not going to convince those people because they have a political agenda, or they have minds that go in that kind of direction," he told CNN. "Conspiratorial theorists are never going to be satisfied. This has gone into another area of political attack."

Logia, you have been saying that for a long time and lets be honest, Obama is no closer to being removed now than he was then.  Obama is the President of the US.  No matter how much you want to pretend that he is a "usurper" or "ineligible", the fact remains that he is the President and can only be removed by impeachment.  So the better question is which Congressman will risk his or her political future by joining the birhter crusade and attempt to bring articles of impeachment againt President Obama?   Come on, you only need one.  The fact of the matter is that Obama is not going anywhere until 2013 the earliest....

If you argue with Obots (Obama’s anti-Birther supporters) enough, you begin encountering the same illogical arguments over and over. Sometime, the sheer volume of the Obot Babble is sooo great, that you don’t see the illogical core of the argument until some time later. Here is one of the Obot’s “best” arguments on why Obama shouldn’t cough up a Long Form Birth Certificate, or some other form of certified document to the PUBLIC, not just some special group.

This is the argument: Obama is under NO LEGAL OBLIGATION to present any documentation of his birth.

You know what??? The Obots are right. There is no LEGAL obligation, but is this a relevant answer to the question of whether Obama SHOULD cough it up??? Let’s see by applying the “Obot” answer to some other questions, and see whether we are satisfied with the response:

Obama has NO LEGAL OBLIGATION to show up at work every day.
Obama has NO LEGAL OBLIGATION to read Congressional Bills before he signs them.
Obama has NO LEGAL OBLIGATION to give a press conference.
Obama has NO LEGAL OBLIGATION to respond to oil spills in the Gulf of Mexico.
Obama has NO LEGAL OBLIGATION to appoint good people to positions.
Obama has NO LEGAL OBLIGATION to pardon innocent people in federal prison.
Obama has NO LEGAL OBLIGATION to worry about unemployment.
Obama has NO LEGAL OBLIGATION to care if Americans starve.
Obama has NO LEGAL OBLIGATION to care if Wall Street steals money from people.
Obama has NO LEGAL OBLIGATION to send enough troops to a war to accomplish anything.
Obama has NO LEGAL OBLIGATION to even sign the Bills passed by Congress.

See how it works??? Legally Obama could sleep until 3:00 in the afternoon, and work one hour a day. Obama could LEGALLY play golf 8 hours a day. He would still get his paycheck. The only people who could stop any of this is Congress, and probably none of this stuff is LEGALLY “high crimes and misdemeanors.” And the answer would be to just not vote for him in 2012. So just looking at this as a LEGAL obligation or responsibility misses the point.

We Americans EXPECT more of our President. And most Presidents deliver, whether we always agree with what they do or not. Sooo, don’t be fooled by this really ILLOGICAL Obot distraction. When 58% of Americans have some degree of doubt where Obama was born, then Obama may not have a LEGAL OBLIGATION, but. . .

Oh well. Let’s see if we can get a permamarker and leave a message for him on some golf balls.

Correct.  And if he did that he would not be reelected in 2012...However he is not doing that.  All President Obama is doing is what every other previous US President has done.  And he is under no obligation to do any more to satisfy a bunch of cranks that have already decided that they won't believe any document released by the state of HI.  As I showed yesterday his approval rating is 50%, which after how tough 2010 was is great..  All he needs is 1% more and he will be reelected President in 2012.  Why should he care about the birthers and their ilk?  No matter what they will never vote for him nor support him.  So he is doing the right think by ignoring them.  Why pander to a bunch of looney toons...
